Rules, requirements, restrictions, and limitations that users must abide by to use the bmy.guide mobile application

Welcome to the bmy.guide application, related software applications (sometimes referred to as “app”), data, SMSv, APIs, email, chat and telephone correspondence, buttons, widgets and ads (collectively, all of these items shall be referred to herein as the “Services”). By accessing or using the Services, you agree to be bound by this Agreement and represent that you have read and understood its terms. Please read this Agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes.

If you do not accept all of these terms and conditions, you are not authorised to use the Services.

The bmy.guide Mobile App is managed by S.C. CRYPTO ORDERS SRL, headquartered in Ghimbav, Gardeniei Street 5, Brasov County, registered with the Trade Registry under no. J08/496/2019, having the fiscal registration code CIF 40559983.

1. General Provisions

By using the mobile app, you agree to the following terms of use.

This document sets out the terms and conditions under which you can use the bmy.guide mobile app (our services). Our Services are provided for the following purposes:

1. To assist users in gathering travel information, posting content and searching for and booking travel services and reservations; and

2. To assist travel, tourism and hospitality businesses in engaging with customers and potential customers, by way of free and/or paid-for services offered by or through bmy.guide.

The access and use of the website and mobile application are subject to the following rules, under the terms and conditions below:

• The purpose of using the website and the mobile application is to obtain information from it and to give access to online services provided through it. Any use for other purposes is not allowed.
• The content on this website or mobile application may be modified and provided “as it is” without any warranty of any kind, whether express or implied
• When accessing the mobile app, please read the Privacy Policy.
• This mobile app uses cookies to provide users with better navigation services. Cookies do not personally identify internet users and they can be disabled, for more details please read our Cookies Policy.

To access certain features of our services, you will need to become an account holder by creating an account. When you create an account, you must provide complete and accurate information. You are solely responsible for the activity that occurs on your account, including your interaction and communication with others, and you must safeguard your account.

bmy.guide offers you the ability to search, select, and book travel reservations with third-party suppliers without leaving our services. By booking via the app, you acknowledge that you accept the practices described in our Privacy Policy and this Agreement. In addition, you warrant, either in your capacity or as a Business Representative, that you are 18 years of age or older, that you possess the legal authority to enter into this agreement and use the services (including the bmy.guide booking facilitation services) by this agreement, and that all information you supply is true and accurate. You further agree that you will use the booking facilitation services only to make legitimate reservations for you or others for whom you are legally authorised to act. Any false or fraudulent reservation is prohibited, and any user who attempts such a reservation may have his or her account terminated.

2. Limitation of Liability

If it is considered that any material made available on the mobile app, posted by BMYGUIDE, by third parties or users, violates the copyright or any other applicable laws, it is necessary to report this situation to support@bmy.guide

You are kindly requested to review this section regularly to keep up to date with any changes made, although we will try to notify you the new versions of it.

3. Copyright and Intellectual Property

Intellectual property rights in the entire content of the site or app, including without limitation all texts, images, graphics, animations, video, sound, attached forms and other similar items (the content) belong exclusively to CRYPTO ORDER SRL.

4. Privacy

SC CRYPTO ORDERS SRL will not automatically collect any information or data that permits the identification of individuals (e.g. name, address, telephone number or e-mail address — “Personal Data”) through the mobile application, unless this information is offered to us voluntarily by application users. This voluntary provision of information will be deemed and will constitute your express consent that your personal data will be used by CRYPTO ORDERS SRL following the terms of Regulation (EU) 2016/679 (GDPR) and the Privacy Policy.

In connection with your data, you have the following rights: the right of access to personal data, the right to rectification or deletion, the right to restrict the processing, or the right to oppose to processing, and the right to data portability. Data portability implies your ability to ask us to transfer all data we hold to another person expressly indicated by you.

If you want to send us a request for your personal data via email, by mail, or phone, use the contact information provided. We will respond to your requests within 30 days of the request at most.

5. Account deletion

If you have a bmy.guide account and wish to permanently delete it, you can do so at any time by choosing to close your account. When you choose to delete your account, you will no longer be able to access our Services.
To permanently delete your account, please follow the steps:

1. Send an email to support@bmy.guide from the email address you initially used to set up your account on bmy.guide. In your email, include the following details:
   - the email address associated with your account
   - your full legal name
   - the name that appears on your profile
   - the location information you’ve entered in your profile
   - the year when your account was established
2. We will address your requests within a maximum of 30 days. You have the option to halt the deletion process at any point during this period. If you decide to do so, please reply to the confirmation email regarding your account deletion, indicating that you no longer want to proceed with removing your account from bmy.guide.
3. When removing your account we delete the following personal information related to your account:
   - Your Profile Information: This includes your profile images, location and everything on your Guideline.
   - Messages and Conversations: Messages you’ve sent to other people may remain visible to them.
   - Data Linked to Your Account: This encompasses information such as your list of users you watch and your personal information from other users’ watch lists.
   - Log Records: log records of your account, which include IP addresses and the dates and times of your interactions with the service
4. When removing your account we keep the following personal information related to your account:
   - When you delete your account on bmy.guide, content you have shared, including images, videos, and text posts, may remain visible on the platform. However, your personal details, such as your name, profile picture, and location, will not be displayed alongside this content. This means that while the content itself might stay accessible to other users, it will be anonymized to prevent direct association with your identity.
5. Important Notes

• The deletion process is not immediate. We allow a 30-day grace period from the date of the request during which you can cancel the deletion process. After this period, it may take up to 60 days for all your information to be completely removed from our platform’s servers.
• Data that others have about you, such as messages you’ve sent, may remain after your account is deleted.

6. Force Majeure

The website and mobile app, affiliates and, in general, information providers of the website and mobile app cannot be held responsible for any delay or error in the content provided by our publications, resulting directly or indirectly from causes not dependent on the will of the site. This exemption includes, but is not limited to: operating equipment errors, lack of Internet connection, lack of telephone connections, computer viruses, unauthorized access to site systems, operating errors, strike, etc.

7. Law Governing the Agreement

The rights and obligations of the parties required by this agreement, as well as all the legal effects of this agreement, shall be construed and governed by the applicable Romanian law. Any dispute relating to this agreement will be brought before the courts in Romania.

8. Final provisions

The terms and conditions apply when you access the website and the mobile app. Thank you for choosing us!
